Terms of Use
Effective date: October 2, 2026
These Terms of Use govern the contractual relationship between 'WIXO App' and merchants or users utilizing the wixo.app website, the merchant administration portal (dashboard.wixo.app), and our software platform that transforms online stores into native mobile applications for iOS and Android.
Who we are and general provisions
The Wixo platform and services (including the public website wixo.app, the merchant control dashboard at dashboard.wixo.app, cloud infrastructure, and mobile integration modules) are operated by 'WIXO App', UIC/VAT ID: BG207772298, registered and located at: Shipka Blvd 23 D, Plovdiv, Republic of Bulgaria, email: info@wixo.app, phone: +359 899 879 134 (referred to herein as 'Wixo', 'Provider', 'we', 'us', or 'our').
These Terms of Use represent a legally binding agreement between Wixo and any natural or legal person who registers, requests a preview/demo, accesses dashboard.wixo.app, orders an integration, or subscribes to a mobile application plan (referred to as 'Client', 'Merchant', or 'you').
By accessing the platform, requesting a demo, logging into dashboard.wixo.app, signing an order, or paying for an integration or subscription, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use in their entirety.
The service we provide
Wixo provides a specialized Software-as-a-Service (SaaS) platform for technical integration, native wrapping, real-time synchronization, and transformation of web-based stores into native mobile apps for Apple iOS and Google Android.
The Service includes automated or semi-automated real-time synchronization of your store's product catalog, pricing, media, and checkout flow, alongside specialized mobile components: bottom tab navigation, push notifications, gamification modules (such as Spin to Win and Scratch Cards), and custom CSS/JS styling rules according to your chosen plan.
Wixo provides technical compilation, configuration, and submission to publish the application onto the Apple App Store and Google Play Store exclusively under Wixo's official developer accounts.
Registration, account, and dashboard access (dashboard.wixo.app)
To manage mobile application configurations, styling, push notification campaigns, and marketing modules, the Merchant is granted secure individual access to the Wixo administration control panel located at: https://dashboard.wixo.app.
Access to dashboard.wixo.app is personal and contingent upon maintaining an active and fully paid subscription plan. The Merchant must provide truthful, accurate, and current contact, billing, and corporate details.
Account Security & Credentials: The Merchant is solely responsible for maintaining the confidentiality and security of their login credentials, passwords, two-factor authentication codes, and integration API keys. All actions, configuration changes, notification dispatches, and campaign launches performed through the Merchant's account in dashboard.wixo.app are deemed executed directly by the Merchant or their authorized agents. Wixo disclaims all liability for losses or unauthorized actions resulting from compromised, lost, or shared credentials.
Acceptable Use & Anti-Spam Policy: When utilizing dashboard.wixo.app to schedule push notifications or configure interactive games (e.g., Spin to Win, Scratch Cards), the Merchant must strictly comply with applicable consumer protection laws, electronic communications directives, and privacy regulations. Dispatching spam, misleading claims, unauthorized advertisements, or fraudulent prize offers is strictly prohibited. The Merchant is legally bound to honor all promotional discounts and rewards presented to customers through the dashboard.
Wixo reserves the right to immediately suspend, restrict, or revoke access to dashboard.wixo.app in cases of suspicious activity, brute-force attempts, API abuse, security vulnerabilities, or material breaches of these Terms.
Responsibility for store content and website modifications
The Merchant retains full, exclusive, and unmitigated legal responsibility for all content, materials, and offerings hosted on their website and rendered within the mobile app. This includes, without limitation: product titles, descriptions, pricing, discounts, stock availability, images, logos, trademarks, banners, promotional materials, and legal policies (terms of sale, return policies, shipping terms).
Wixo acts strictly and solely as a technical software provider and interface framework. Wixo does not pre-screen, audit, curate, endorse, or verify any products, inventory, or claims published by the Merchant.
DISCLAIMER OF LIABILITY FOR WEBSITE OR STRUCTURAL MODIFICATIONS: If the Merchant or any third party authorized by the Merchant alters, updates, or modifies the website source code, database, CMS, theme, checkout flow, third-party plugins, server environment, domain, or SSL certificates, and such modifications cause visual defects, broken checkout, sync interruptions, app crashes, or operational failures in the mobile app, WIXO BEARS NO LIABILITY WHATSOEVER for any resulting damages, lost revenue, lost sales, or customer dissatisfaction.
Any emergency technical support, debugging, or custom code adaptations required to re-establish mobile app functionality following changes on the Merchant's website that exceed the included monthly support scope will be billed separately at Wixo's standard technical engineering rates.
Right to suspend, deactivate, and terminate the application
Wixo reserves the unilateral, absolute, and immediate right to suspend, restrict, deactivate, or terminate the mobile application, push notification dispatch, or platform access, without prior notice and without liability for damages or refund of prepaid fees, under any of the following circumstances:
a) The Merchant's store or mobile content violates applicable national laws, European Union directives, or international regulations;
b) The store offers, markets, or distributes restricted or prohibited goods and services, including: firearms and ammunition, narcotics or controlled substances, unapproved pharmaceuticals, counterfeit goods or unauthorized replicas, illegal gambling, pornographic or adult content, deceptive financial schemes, hate speech, or content promoting violence and discrimination;
c) Wixo receives a formal notification, court order, regulatory notice (e.g. consumer protection, police), or substantiated intellectual property infringement claim (copyright, trademark, or patent violation) regarding the Merchant's content;
d) The Merchant's store activities or traffic patterns jeopardize the technical stability, operational security, or reputation of Wixo's platform or infrastructure;
e) The Merchant defaults on any subscription or invoice payment for more than 7 (seven) calendar days past the due date.
App Store and Google Play submission and compliance
Publishing mobile applications is subject to the independent and strict review policies of Apple Inc. (Apple Developer Program License Agreement and App Store Review Guidelines) and Google LLC (Google Play Developer Distribution Agreement and Developer Program Policies).
Distribution Model: All mobile applications are compiled, published, and maintained in the Apple App Store and Google Play exclusively through Wixo's official developer accounts ('WIXO App'). Wixo does not offer the service or option for merchants to publish applications under their own individual developer accounts. The Merchant is not required to create, maintain, or pay enrollment fees for their own developer accounts with Apple or Google.
Platform Fees & Commissions: Wixo does not cover, absorb, or assume liability for any platform fees, transaction commissions, payment surcharges, or regulatory levies imposed by Apple (iOS) or Google (Android) in connection with the Merchant's commercial operations, merchandise sales, orders, or payment gateways.
While Wixo utilizes industry best practices and technical optimizations to facilitate app approval, WIXO CANNOT AND DOES NOT GUARANTEE that Apple or Google will permanently approve, publish, or keep listed the Merchant's application.
Apple and Google retain full discretion to modify their store review guidelines, developer rules, privacy standards, or technical criteria at any time, or to unpublish (delist) or reject any application based on the Merchant's store content, business model, or platform policy changes. Wixo is not liable for store rejections, publishing delays, or app removals resulting from Merchant website content, intellectual property claims, or platform policy updates.
Subscription plans, fees, and billing
Access to Wixo mobile platform services is provided on a recurring subscription basis (monthly or yearly) under the Start, Standard, Pro, or custom Ultra Pro plans, as detailed on our Pricing page.
All listed prices are in Euros (€) excluding applicable VAT, unless explicitly noted otherwise. Subscription fees are payable in advance prior to the start of each billing cycle via credit/debit card, bank transfer, or designated payment processors.
Yearly subscription commitments receive a preferential pricing discount equivalent to one month free.
The one-time setup and integration fee (where applicable) covers the technical configuration, testing, and store submission preparation, and is non-refundable once technical integration work has been initiated.
Intellectual property
All intellectual property rights in and to the Wixo platform, including the software and user interface of dashboard.wixo.app, native mobile shells, integration code, algorithms, visual design modules, trademarks, and service marks are and remain the exclusive property of 'WIXO App'.
The Merchant is granted a limited, non-exclusive, revocable, and non-transferable license to utilize the mobile application functionality and dashboard.wixo.app solely during an active, paid subscription term and exclusively for their designated online store.
The Merchant retains all ownership rights to their proprietary brand assets, logos, content, and product imagery, granting Wixo a non-exclusive license to display and format these assets solely for building, operating, and presenting the application.
Limitation of liability and warranties
The Wixo service is provided on an 'as is' and 'as available' basis, without express or implied warranties of any kind, including merchantability, fitness for a particular purpose, or uninterrupted availability.
Wixo shall not be liable for service disruptions, notification delays, or data synchronization interruptions caused by force majeure events, telecom failures, Merchant hosting server downtime, mobile carrier blockages, or outages in Apple or Google cloud infrastructure.
Under no circumstances shall Wixo, its officers, employees, or partners be liable for indirect, incidental, special, punitive, or consequential damages, including loss of business revenue, lost profits, lost sales, reputational damage, or loss of customer data.
Wixo's total aggregate financial liability arising out of or related to these Terms or the service, regardless of the form of action, is strictly limited to the total fees actually paid by the Merchant to Wixo in the three (3) calendar months preceding the incident.
Term and termination
Subscription agreements commence upon payment and automatically renew for successive monthly or annual periods unless cancelled by either party.
The Merchant may terminate their subscription at any time by providing written notice via email at least fifteen (15) days prior to the expiration of the current billing cycle.
Upon termination, mobile push notification dispatch, dashboard.wixo.app access, server synchronization, and ongoing app maintenance will cease at the end of the paid billing period. Prepaid fees are non-refundable.
Changes to these terms
Wixo reserves the right to amend or update these Terms of Use periodically to reflect changes in our services, legal mandates, or platform requirements from Apple and Google.
Updated terms become effective immediately upon posting to the wixo.app website with an updated effective date. Continued use of the platform following any modifications constitutes acceptance of the revised Terms.
Governing law, jurisdiction, and contact
These Terms of Use shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of Bulgaria and European Union law.
Any dispute, controversy, or claim arising out of or relating to these Terms shall be resolved amicably through good-faith negotiation, and failing agreement, submitted to the exclusive jurisdiction of the competent courts in Plovdiv, Republic of Bulgaria.
